Google Analytics And the GDPR

Website Analytics: Google or Matamo?

Understanding how and what website users do at your website helps you build a better website and optimize your marketing.

Google has announced that it is retiring their “Universal Analytics” (UA) in July, 2023 and replacing it with Google Analytics 4 (G4).

But why the change? What is the driving force?

While the USA, federal government, has no privacy laws, some State, California and Nevada have enacted privacy regulations to protect users on the internet.

In Europe it’s a different story. For several years now the European General Data Protection Regulation (GDPR, also known as DSGVO in German, and RGPD in French) has been in force.

The Google move to G4, away from UA, is driven by European regulators.

This is the sensitive data, per GDPR, that is currently the focus of being protected on each individual internet user is as follows:

  • Racial or ethnic origin
  • Employment status
  • Religious or political beliefs
  • State of health
  • Genetic or biometric data
  • Financial records (such as payment method data)
  • Address and phone numbers

As well, the GDPR says that the main principles of individual privacy are these seven Standards:

  • Lawfulness, fairness and transparency— data must be obtained legally, collected with consent and in adherence to laws.
  • Purpose limitation— all personal information must be collected for specified, explicit and legal purposes.
  • Data minimisation— companies must collect only necessary and adequate data, aligned with the stated purpose.
  • Accuracy— data accuracy must be ensured at all times. Companies must have mechanisms to erase or correct inaccurate data without delays.
  • Storage limitation— data must be stored only for as long as the stated purpose suggests. Though there’s no upper time limit on data storage.
  • Integrity and confidentiality (security)— companies must take measures to ensure secure data storage and prevent unlawful or unauthorised access to it.
  • Accountability— companies must be able to demonstrate adherence to the above principles.

In 2019 French regulators were successful in proving Google was not meeting those seven Standards and Google was fined millions of dollars.

While G4 has made progress to satisfy the GDPR, it still has limitations.

Google Analytics has no process for intra-EU data storage, selecting a designated regional storage location, or informing users about data storage location or data transfers outside of the EU. That limitations put Google in violation of the GDPR as of today.

CURRENT STATUS

Google Analytics non-compliance with GDPR, effectively means any website tracking or analyzing European visitors is open to legal persecution.

  • Sweden first fined Google for violating GDPR for no not fulfilling its obligations to request data delisting in 2020.
  • France rejected Google Analytics 4 IP address anonymization function as a sufficient measure for protecting cross-border data transfers. Even with it, US intelligence services can still access user IPs and other PII. France declared Google Analytics illegal and pressed a €150 million fine.
  • Austria also found Google Analytics GDPR non-compliant and proclaimed the service as “illegal”. The authority now seeks a fine too.
  • The Dutch Data Protection Authority and Norwegian Data Protection Authority also found Google Analytics guilty of a GDPR breach and seek to limit Google Analytics usage.

SUMMARY

On websites I build and track I use G4 plus Matamo Analytics, which is in compliance with the GDPR.

Everyone is familiar with the idea of renting versus buying a home.

That comparison has a lot of similarities to an online business when it comes to where you place your “hub”.

This hub is your website - the location or URL or webpage(s) where people find out about your services.

The question is, “Do you own your internet hub?”

The only way to answer, in the affirmative, is when you have a website where you own the domain and the content.

Here are some examples of online business model where the hub is not owned by the business owner.

You don’t own your online business hub in the following scenarios….
- Meta, aka Facebook
- Youtube videos
- Vimeo videos
- Twitter
- Instrgram
- Box store websites: Shopify, Wix, Squarespace, and so on.

5 STEPS: How to own your website, aka online hub.


- Buy your domain. This can be easily accomplished at Google Domains.
- Find a website host to publish your website.
- Create content or pay someone, and make sure whoever you pay gives you all ownership rights.
- Place your logo in the media you create and publish.
- Publish content in social media and be sure to add links to your website in each posting/video description.

AN EXAMPLE
Always remember that your investment in building content leads to building your business reputation.

When you build your online presence in a place you do not own, the links to that content, referred to as inbound marketing links, disappear when you move your online presence from that location.

For example, say you buy a presence in Shopify. After a few years you see that the fees you pay there are too much. So, you decide to start a website - own your online hub, All the links from other websites that connect to your Shopify location will be lost.

SHORT TERM
The #1 goal of all websites is building organic listings in the search results when someone is looking for the products and services you offer.

You don’t pay for organic listings because they are not advertising. You build organic links using proven SEO techniques.

LONG TERM
Building your business reputation is almost always fortified with additional inbound links. Those links are from others sites that link to your site. In marketing terms, those links tell the search engine bots your site is useful and important.

SUMMARY
You can move website sites along the path of growing your business.

I have built, from ground zero, organic search results for three different domains as my business expanded during the last 10 years. My current domain project is PlanOfDevelopment.com

Moving your site - hub, from one one domain to anther domain, requires using “permanent link” forwarding. When you use a box store to build your website, the “permanent link” forwarding is not available.

It is possible to move your site successfully, but it works best when you clearly understand the details, and necessary sequence, before you begin the project.

I want to share three important facts, I have dicovered, about the nature of wensite analytics.

First, if you want to optimize your organic results in Google search results, you MUST use Google Analytics. And, as I mentioned previously in last post, Google Analytics has now evolved in to G4.

With G4 you must use the tag manager and install all least the default tags. You take it many more steps, the easier one being to measure conversion by actions people take on a page. For example, clicking a button is a conversion, or watching a video is a conversion.

Second, Matamo Analytics is an equal too, or maybe superior, product compared to Goggle Analytics - G4. One nice feature is you can configure a screen that appears to website visitors where they can choose which cookies can track them.

Or, you can set all data collection to anonymous thereby bypassing need for that screen. I think there is a option in G4 tags that allows to set all data collection to anonymous but until i test it I am not taking Google’s word for it.

Matamo is based in Germany so privacy rules there are compliant with European Union.

Third, there is no federal law dealing with internet privacy in the USA.

Some States, California and Nevada come to mind, have adopted privacy protection regulations. Until the federal government adopts privacy regulation,

I see no need to use cookie banners on website sites. Yet,I do have privacy policies on websites I manage, which identify the nature of cookies and how that stored data is used.

I don’t work with business that sell visitor data to third parties, no looming tar pits in that area on my websites.

SUMMARY
At a bare minimum it is wise to have a privacy policy that describes how you share cookie data collected on your site.

Check you visitor logs, if you have visitors from California or Nevada you want to have that specific info, from each State, clearly stated in your privacy policy.

If you have European visitors on your webs pages you better be complaint with GDPR. Matamo is excellent with that and Google not so much.

The media that showcases your business is the foundation of your online business. When you have all your media that you distribute leading back to your website, you effectively own your business on the internet.

As the internet continues to evolve, platforms like Facebook are common and respected locations to distribute media about your business. As people on various platforms see your media, your goal is to have them connect to your website.

As website visitors are viewing your website content, hopefully, they will be converted into a business opportunity by sending you a question or setting up an appointment.

4 Key Understandings In Owning Your Online Business

I believe the four key points below identify the foundation of your online business. These points must be periodic updated to keep pace with new requirements of search algorithms and upgrades in technology processes.

"The French Data Protection Agency, CNIL (Commission nationale de l’informatique et des libertés), has concluded that the use of Google Analytics is illegal under GDPR. The CNIL has begun issuing formal notices to website managers using Google Analytics.

This follows the January 2022 Austrian Data Protection Authority’s decision to declare Google Analytics illegal to use under GDPR. Under the GDPR, personal data covers a range of identifiers including email address, race, gender, phone number to name a few, but the less obvious identifiers include IP addresses or cookie IDs, for instance.

Since the invalidation of the Privacy Shield framework, an agreement between the EU and US that allowed the transfer of data to certified US companies, the CNIL and other EU data protection authorities have received numerous complaints regarding data transfers collected during visits to websites using Google Analytics."

The General Data Protection Regulation (EU) (GDPR) is a regulation in EU law on data protection and privacy in the European Union (EU) and the European Economic Area (EEA). The GDPR is an important component of EU privacy law and of human rights law, in particular Article 8(1) of the Charter of Fundamental Rights of the European Union. It also addresses the transfer of personal data outside the EU and EEA areas.

The GDPR was adopted on 14 April 2016 and became enforceable beginning 25 May 2018. As the GDPR is a regulation, not a directive, it is directly binding and applicable, and provides flexibility for certain aspects of the regulation to be adjusted by individual member states.

There are currently no federal laws or regulations in the USA about website visitor privacy rights. However, California and Nevada do have requirements at his time.

To be in complaince with the GDPR ......

Is your website, using Google Analytics? If so you must ask for consent from everyone who visits your website. If you don’t, you could be liable to privacy law infringements and face being fined for not complying with the GDPR. That consent needs to be

  1. Freely given (the user must have a choice to not give consent and be able to opt out at any time).
  2. Informed (you need to disclose who is processing the data, what data is processed and how to opt out)
  3. Specific (consent is only valid for the specific informed purpose)
  4. Unambiguous (for example, pre-ticked boxes or similar aren’t allowed)
    Those four characteristics invalidate 99% of all "cookie notices" you see today on USA websites. If users don’t give you consent, you are not allowed to track them using Google Analytics or any other US based cloud solution.

Replace Google Analytics with program not based in USA. Matomo Analytics is one I have begun using; its' servers are based in Germany. Matomo satisfies CJEU privacy shield requirements.
